This Privacy Policy describes how Listinghost, LLC ("Listinghost," "we," "us," or "our") collects, uses, discloses, and protects information in connection with our website, software, hosted listing pages, QR code tools, SMS and messaging features, AI-assisted listing engagement tools, dashboards, support services, and related products and services (collectively, the "Services").
This Privacy Policy applies to information we collect from:
- visitors to our website;
- customers, including agents, brokerages, teams, builders, developers, and other business users of the Services;
- buyers, prospects, and other individuals who interact with Listinghost-powered listing experiences, hosted pages, QR codes, or messaging flows; and
- individuals who contact us for support, demos, or other inquiries.
By accessing or using the Services, you acknowledge the practices described in this Privacy Policy.
1. Information We Collect
1.1 Information You Provide Directly
We may collect information you provide directly to us, including:
- name, email address, phone number, brokerage or company name, job title, and other account or profile information;
- billing, subscription, and transaction information;
- support requests, demo requests, and other communications with us;
- listing information, property details, disclosures, showing instructions, notes, PDFs, flyers, MLS printouts, images, and other materials uploaded to the Services;
- lead data, conversation data, follow-up notes, tags, workflow information, and similar business records entered by customers or generated through use of the Services; and
- any other information you choose to submit through the Services.
1.2 Information Collected Through SMS and Messaging Features
When you opt in to receive text messages, text a Listinghost-powered number, scan a QR code and initiate a message, or otherwise interact with our SMS or messaging features, we may collect:
- your mobile phone number;
- the content of messages you send and receive;
- the date, time, and time zone of messages;
- opt-in and opt-out records, including timestamps, disclosure versions, and related consent or revocation information;
- property addresses, preferences, showing requests, scheduling information, and other information you provide in connection with a listing inquiry; and
- metadata necessary to provide, secure, and support the messaging experience.
1.3 Information Collected Automatically
We and our service providers may automatically collect certain information about your use of the Services, including:
- IP address, browser type, device type, operating system, referring URLs, and approximate location derived from IP address;
- pages viewed, links clicked, features used, dates and times of access, and other usage information;
- log data, diagnostics, crash information, and performance information; and
- cookie, pixel, local storage, and similar technology data as described in Section 12.
1.4 Information from Other Sources
We may receive information from other sources, including:
- service providers, analytics vendors, and cloud providers;
- payment processors;
- integrated CRM, MLS, communications, or other third-party systems that you or our customers connect to the Services;
- your brokerage, employer, team administrator, or other organization that provides you access to the Services; and
- publicly available sources or referral sources, to the extent permitted by law.
2. Categories of Personal Information
Depending on how you interact with the Services, we may collect the following categories of personal information:
- identifiers, such as name, email address, phone number, IP address, account identifiers, and online identifiers;
- commercial information, such as subscription, billing, transaction, and account history information;
- internet or other electronic network activity information, such as browsing activity, feature usage, device logs, and interaction data;
- geolocation data derived from IP address or device information;
- audio, electronic, visual, or similar information, such as message content, uploaded images, PDFs, and support communications;
- professional or employment-related information, such as brokerage, company, title, and role information; and
- inferences drawn from the information above, such as lead-routing, workflow, or listing-response insights generated to support the Services.
We collect and use these categories for the purposes described in Sections 3 through 8 of this Privacy Policy.
3. How We Use Information
We may use the information we collect to:
- provide, operate, maintain, secure, and support the Services;
- create and manage accounts and subscriptions;
- host listing experiences, generate QR assets, facilitate listing-related conversations, and route inquiries;
- respond to questions, deliver requested listing information, coordinate follow-up, and provide customer support;
- send transactional, informational, support, and operational communications, including text messages where you have opted in or otherwise provided any consent required by applicable law;
- process billing and payments;
- maintain records of consent, opt-in, opt-out, and compliance activity;
- monitor usage, analyze performance, troubleshoot issues, and improve the Services;
- develop, train, test, improve, and support automation, AI-assisted, and other product features using permitted data;
- detect, investigate, and prevent fraud, abuse, unauthorized activity, or security incidents;
- enforce our agreements, policies, and legal rights; and
- comply with legal, regulatory, contractual, and industry obligations.
We process personal information as reasonably necessary and proportionate to achieve the purposes described in this Privacy Policy, to provide services requested by you or our customers, to comply with legal obligations, and to protect the security and integrity of the Services.
4. Controller, Business, Service Provider, and Processor Roles
Listinghost may act in different privacy roles depending on the context in which information is processed.
- When Listinghost acts on behalf of a customer. When a customer uses the Services to collect, route, review, manage, or respond to buyer, prospect, or lead information, Listinghost generally acts as a service provider or processor on behalf of that customer.
- When Listinghost acts for its own business purposes. When Listinghost processes information for account administration, billing, security, fraud prevention, legal compliance, service analytics, de-identified product improvement, support, and similar internal business operations, Listinghost generally acts as a controller or business for those purposes.
5. Customer-Directed Communications and Platform Role
Listinghost provides technology that enables customers such as agents, brokerages, teams, builders, and developers to create listing-related experiences and communicate with buyers, prospects, and other contacts.
In many cases, the content, timing, audience, purpose, or follow-up for a communication is determined by the Listinghost customer associated with the listing or inquiry. When you interact with a Listinghost-powered listing flow, your information may be processed by Listinghost on behalf of that customer in order to facilitate the requested communication, listing response, lead capture, support, compliance logging, or follow-up.
When Listinghost discloses your information to the Listinghost customer associated with the listing or inquiry, that customer's own privacy practices may govern its use of the information outside the Listinghost platform. See Section 6.2 below.
6. How We Disclose Information
We may disclose information in the following circumstances:
6.1 Service Providers
We may disclose information to vendors and service providers that help us operate the Services, including providers of cloud hosting, messaging, communications, analytics, customer support, billing, security, infrastructure, and fraud-prevention services.
6.2 Listinghost Customers and Their Authorized Users
If you interact with a Listinghost-powered listing or messaging flow, we may disclose your information, inquiry details, and conversation content to the relevant Listinghost customer and its authorized users, such as the agent, brokerage, team, builder, developer, or other representative associated with the listing or inquiry, for the purpose of responding to your request, coordinating follow-up, servicing the inquiry, and managing the customer relationship.
Once information is disclosed to the relevant Listinghost customer, that customer's own privacy practices and policies apply to its use of the information outside the Listinghost platform. Listinghost is not responsible for a customer's independent privacy practices outside the Services.
6.3 Third-Party Integrations
If a customer chooses to connect a third-party integration, we may disclose information to or receive information from that third party as necessary to support the integration.
6.4 Legal, Safety, and Protection of Rights
We may disclose information if we believe doing so is necessary or appropriate to comply with law, legal process, regulatory request, or enforceable governmental request; to enforce our agreements; to detect or investigate fraud, abuse, or security issues; or to protect the rights, property, or safety of Listinghost, our users, or others.
6.5 Corporate Transactions
We may disclose information in connection with an actual or proposed merger, acquisition, financing, sale of assets, reorganization, bankruptcy, or similar transaction.
6.6 De-Identified and Aggregated Information
We may use and disclose de-identified, anonymized, or aggregated information for analytics, security, benchmarking, service improvement, and product development.
6.7 No Sale or Sharing for Advertising
Listinghost does not sell personal information and does not share personal information for cross-context behavioral advertising as those terms may be defined under applicable state privacy laws.
6.8 No Sale or Sharing of SMS Opt-In Data for Marketing
We do not sell or share your mobile number or SMS opt-in information with third parties or affiliates for their own marketing or promotional purposes.
7. AI-Assisted Features and Product Improvement
The Services may include automation, artificial intelligence, machine learning, or rules-based features that generate suggested responses, summaries, classifications, or other outputs.
We may use Customer Content, support data, and other information collected through the Services to operate, maintain, test, improve, and support these features, subject to our contractual obligations, this Privacy Policy, and applicable law.
Unless otherwise stated in a customer agreement or product setting, Listinghost may use de-identified and aggregated data derived from product usage, support interactions, and service performance to improve AI-assisted and messaging experiences. If Listinghost uses personal information or identifiable conversation data to train or improve AI-assisted features, it will do so only as permitted by applicable law, customer agreement, and disclosed product settings.
Where required by applicable law or contract, Listinghost will honor restrictions on the use of customer data for model training or improvement. If Listinghost makes an AI training or model-improvement restriction setting available in the product, customers may use that setting in accordance with the applicable product documentation.
8. Data Retention
We retain information for as long as reasonably necessary to provide the Services, maintain business and compliance records, resolve disputes, enforce our agreements, and comply with legal obligations.
Retention periods may vary depending on the type of information, the customer relationship, account settings, plan terms, legal obligations, operational need, and whether the information is needed for security, fraud prevention, or litigation defense.
Examples of how we apply retention criteria include:
- account and subscription records, which may be retained for the life of the account and for a reasonable period afterward;
- billing and payment records, which may be retained for financial, tax, and audit purposes;
- consent, opt-in, opt-out, and related messaging compliance records, which may be retained for compliance, dispute-resolution, and litigation-defense purposes;
- support, security, and incident-response records, which may be retained as reasonably necessary to investigate and resolve issues; and
- de-identified and aggregated information, which may be retained for analytics, benchmarking, and product improvement.
Certain lead and conversation data may also be subject to customer-configured retention controls made available through the Services. Where applicable to a customer's account configuration, Listinghost may apply a default retention period for certain conversation or lead records unless the customer customizes those settings or applicable law requires otherwise.
9. Privacy Rights and Choices
Depending on where you live and how you interact with the Services, you may have certain rights regarding your personal information, subject to exceptions and limitations under applicable law.
Listinghost will not discriminate against you, retaliate against you, deny goods or services to you, charge you different prices or rates, or provide you a different level or quality of services because you exercised any privacy rights available to you under applicable law.
9.1 General Rights
Depending on applicable law, you may have the right to:
- confirm whether we process your personal information;
- access or know the personal information we hold about you;
- correct inaccuracies in your personal information;
- delete personal information;
- obtain a copy of certain personal information in a portable format; and
- appeal a denial of your privacy request, where applicable law provides that right.
You may also have the right, under certain state laws, to opt out of:
- the sale of personal information;
- the sharing of personal information for cross-context behavioral advertising;
- targeted advertising; or
- profiling in furtherance of decisions that produce legal or similarly significant effects concerning you.
Listinghost does not currently sell personal information or share personal information for cross-context behavioral advertising.
9.2 How to Exercise Privacy Rights
You may submit privacy requests by contacting us at [email protected]. To help us route and track your request efficiently, please include "Privacy Request" in the subject line where possible. We may need to verify your identity and authority before fulfilling certain requests. We will respond within the time required by applicable law.
If we deny your request, you may appeal that decision by replying to our response or by contacting [email protected] and stating that you wish to appeal the denial of your privacy request, where applicable law provides such a right.
9.3 California-Specific Disclosures
For California residents, Listinghost describes in this Privacy Policy:
- the categories of personal information collected in Section 2;
- the sources of personal information in Section 1;
- the business and commercial purposes for collection, use, and disclosure in Sections 3, 5, 7, and 8;
- the categories of third parties and disclosures in Section 6; and
- Listinghost's position that it does not sell personal information and does not share personal information for cross-context behavioral advertising, as described in Sections 6.7 and 9.
California residents may have rights to know, delete, correct, and obtain a copy of personal information, to opt out of sale or sharing, and to non-discrimination for exercising privacy rights, subject to exceptions under California law.
9.4 Texas-Specific Disclosures
For Texas residents, Listinghost describes in this Privacy Policy:
- the categories of personal data processed in Sections 1 and 2;
- the purposes for processing personal data in Sections 3, 5, 7, and 8;
- the categories of personal data shared with third parties in Section 6; and
- the rights available to consumers under applicable Texas law, including rights to access, correct, delete, obtain a copy of personal data, opt out of certain processing, and appeal a denied request, subject to applicable exceptions.
9.5 SMS Choices
You may opt out of SMS messages at any time by replying STOP. You may request help by replying HELP or by contacting us at [email protected].
You may also revoke consent to receive text messages using another reasonable method that clearly communicates your request. We will process valid opt-out and revocation requests as soon as reasonably practicable and, in any event, within ten (10) business days after receipt, except where a shorter period is required by applicable law.
Unless Listinghost expressly discloses otherwise at the time of opt-in, an opt-out or revocation request will be treated as applying to the SMS Program as a whole and not only to a particular listing, property, or inquiry. To receive messages again after a program-wide opt-out, you must provide a new opt-in.
9.6 Cookies, Do Not Track, and Global Privacy Control
You may control cookies through your browser settings and other available tools, although disabling certain technologies may affect functionality.
Because there is not yet a universally accepted standard for browser-based Do Not Track signals, our websites may not respond to all Do Not Track signals.
Where required by applicable law, Listinghost will treat a recognized Global Privacy Control (GPC) signal as a valid request to opt out of the sale or sharing of personal information for the browser or device associated with that signal.
10. Security and Incident Response
We implement commercially reasonable administrative, technical, and organizational safeguards designed to protect information against unauthorized access, use, alteration, or disclosure. No security measure is perfect, and we cannot guarantee absolute security.
If Listinghost becomes aware of a security incident involving personal information, we will investigate, take appropriate remedial steps, and provide notice to affected individuals and regulators where required by applicable law.
11. Children's and Minors' Privacy
The Services are not directed to children under 13, and we do not knowingly collect personal information from children under 13 through the Services.
The SMS Program is intended only for individuals who are at least 18 years old. Listinghost does not knowingly sell personal information, share personal information for cross-context behavioral advertising, or engage in marketing directed to individuals under 18 through the SMS Program.
12. Cookies and Similar Technologies
We and our service providers may use cookies, pixels, local storage, log files, and similar technologies to operate the Services, remember preferences, maintain sessions, analyze usage, improve performance, and support security.
We may use strictly necessary cookies and similar technologies, performance and analytics technologies, and security-related technologies. As of the Effective Date of this Privacy Policy, Listinghost does not use this Privacy Policy to describe any sale of personal information or sharing for cross-context behavioral advertising. If our tracking practices materially change, we will update this Privacy Policy and provide any disclosures or choices required by applicable law.
13. Third-Party Services and Links
The Services may contain links to third-party websites, tools, or services, or may interoperate with third-party systems. We are not responsible for the privacy practices, content, or policies of third parties. Your interactions with third-party services are governed by their own terms and policies.
14. International Use
The Services are intended for use in the United States and are not directed to individuals outside the United States. If you access the Services from outside the United States, you understand that your information may be transferred to, stored in, and processed in the United States or other jurisdictions where our service providers operate.
15. Changes to This Privacy Policy
We may update this Privacy Policy from time to time. If we make material changes, we may provide notice by posting the updated Privacy Policy, updating the Effective Date or Last Updated date, emailing the account owner, providing in-product notice, or, where appropriate, providing notice by text message to active SMS Program participants. Your continued use of the Services after the effective date of the updated Privacy Policy constitutes your acceptance of the updated Privacy Policy. If you do not agree to the updated Privacy Policy, you should stop using the Services and, if applicable, opt out of SMS messages by replying STOP.
